The Federal Court of Australia has dismissed a legal challenge against the Australian Government Department of Climate Change, Energy, the Environment and Water’s approval of the Nyah Floodplain Restoration Project. The case was brought by the Friends of Nyah-Vinifera Park, which argued that alternatives to the project had not been adequately considered before federal approval was granted in March 2024. The restoration project involves the installation of levees, pumps and water regulators at Nyah and Vinifera to better manage environmental flows into Nyah-Vinifera Park along the Murray River flood plain between Swan Hill and Mildura. Prior assessments acknowledged that construction would affect more than 14 hectares of native vegetation, including breeding and foraging habitat for the vulnerable Regent Parrot. With the court finding no legal errors in the Commonwealth’s decision-making process, installation of containment gates and regulators is now proceeding as part of the broader Victorian Murray Floodplain Restoration Program.
